Parole

Parole (pronounced puh-rohl or pa-rawl (French))

(1) In penology, the (supervised) conditional release of an inmate from prison prior to the end of the maximum sentence imposed.

(2) Such a release or its duration.

(3) An official document authorizing such a release (archaic except as a modifier).

(4) In military use, the promise (usually in the form of a written certificate) of a prisoner of war, that if released they either will return to custody at a specified time or will not again take up arms against their captors.

(5) Any password given by authorized personnel in passing by a guard (archaic but still used in video gaming).

(6) In military use, a watchword or code phrase; a password given only to officers, distinguished from the countersign, given to all guards (archaic but still used in video gaming).

(7) A word of honor given or pledged (archaic).

(8) In US immigration legislation, the temporary admission of non-U.S. citizens into the US for emergency reasons or on grounds considered in the public interest, as authorized by and at the discretion of the attorney general.

(9) In structural linguistics, language as manifested in the individual speech acts of particular speakers (ie language in use, as opposed to language as a system).

(10) To place or release on parole.

(11) To admit a non-US citizen into the US as provided for in the parole clauses in statute.

1610–1620: From the Middle French parole (word, formal promise) (short for parole d'honneur (word of honor)), from the Old French parole, from the Late Latin parabola (speech), from the Classical Latin parabola (comparison), from the Ancient Greek παραβολή (parabol) (a comparison; parable (literally “a throwing beside”, hence “a juxtaposition").  The verb was derived from the noun an appeared early in the eighteenth century; originally, it described “what the prisoner did” (in the sense of a “pledge”) but this sense has long been obsolete.  The transitive meaning “put on parole, allow to go at liberty on parole” was in use by the early 1780s while the use to refer to “release (a prisoner) on his own recognizance” doesn’t appear for another century.  The adoption in English was by the military in the sense of a “word of honor” specifically that given by a prisoner of war not to escape if allowed to go about at liberty, or not to take up arms again if allowed to return home while the familiar modern sense of “a (supervised) conditional release of a inmate before their full term is served” was a part of criminal slang by at least 1910.  An earlier term for a similar thing was ticket of leave.  In law-related use, parol is the (now rare) alternative spelling.  Parole is a noun & verb, parolee is a noun, paroled & paroling are verbs and parolable, unparolable, unparoled & reparoled are adjectives (hyphenated use is common); the noun plural is paroles.

A parole board (or parole authority, parole panel etc) is panel of people who decide whether a prisoner should be released on parole and if released, the parolee is placed for a period under the supervision of a parole officer (a law enforcement officer who supervises offenders who have been released from incarceration and, often, recommends sentencing in courts of law).  In some jurisdictions the appointment is styled as “probation officer”.  The archaic military slang pass-parole was an un-adapted borrowing from French passe-parole (password) and described an order passed from the front to the rear by word of mouth. Still sometimes used in diplomatic circles, the noun porte-parole (plural porte-paroles) describes “a spokesperson, one who speaks on another's behalf” and was an un-adapted borrowing from mid sixteenth century French porte-parole, from the Middle French porteparolle.

The Parole Evidence Rule

In common law systems, the parol evidence rule is a legal principle in contract law which restricts the use of extrinsic (outside) evidence to interpret or alter the terms of a written contract.  The operation of the parol evidence rule means that if two or more parties enter into a written agreement intended to be a complete and final expression of their terms, any prior or contemporaneous oral or written statements that contradict or modify the terms of that written agreement cannot be used in court to challenge the contract’s provisions.  The rule applies only to properly constructed written contracts which can be regarded as “final and complete written agreements” and the general purpose is to protect the integrity of the document.  Where a contract is not “held to be final and complete”, parol evidence may be admissible, including cases of fraud, misrepresentation, mistake, illegality or where the written contract is ambiguous.  The most commonly used exceptions are (1) Ambiguity (if a court declares a contract term ambiguous, external evidence may be introduced to to clarify the meaning), (2) Void or voidable contracts (if a contract was entered into under duress or due to fraud or illegality, parol evidence can be used to prove this.  In cases of mistakes, the scope is limited but it can still be possible), (3) Incomplete contracts (if a court determines a written document doesn’t reflect the full agreement between the parties, parol evidence may be introduced to “complete it”, (4) Subsequent agreements (modifications or agreements made after the written contract can generally be proven with parol evidence although in the narrow technical sense such additions may be found to constitute a “collateral contract”.

Parole & probation

Depending on the jurisdiction, “parole” & “probation” can mean much the same thing or things quite distinct, not helped by parolees in some places being supervised by “probation officers” and vice versa.

In the administration of criminal law, “parole” and “probation” are both forms of supervised release but between jurisdictions the terms can either mean the same thing or be applied in different situations.  As a general principle, parole is the conditional release of a prisoner before completing their full sentence and those paroled usually are supervised by a parole officer and must adhere to certain conditions such as regular meetings, drug testing and maintaining employment and certain residential requirements.  The purpose of parole is (1) a supervised reintegration of an inmate into society and (2) a reward for good behavior in prison.  Should a parolee violate the conditions of their release, they can be sent back to prison to serve the remainder of their sentence.  As the word typically is used, probation is a court-ordered period of supervision in the community instead of, or in addition to, a prison sentence.  A term of probation often imposed at sentencing, either as an alternative to incarceration or as a portion of the sentence after release.  Like parolees, individuals on probation are monitored, often by a probation officer (although they may be styled a “parole officer”) and are expected to follow specific conditions.  Probation is in many cases the preferred sentencing option for first offenders, those convicted of less serious offences and those for whom a custodial sentence (with all its implications) would probably be counter-productive.  It has the advantage also of reducing overcrowding in prisons and is certainly cheaper for the state than incarceration.  Those who violate the terms of their probation face consequences such as an extended probation or being sent to jail.  The word “parole” in this context was very much a thing of US English until the post-war years when it spread first to the UK and later elsewhere in the English-speaking world.

Langue & parole

In structural linguistics, the terms “langue” & “parole” were introduced by the groundbreaking Swiss semiotician Ferdinand de Saussure (1857-1913) and remain two of the fundamental concepts in the framework of structuralism and are treated as important building blocks in what subsequently was developed as the science of human speech.  Within the profession, “langue” & “parole” continue to be regarded as “French words” because the sense in that language better describes things than the English translations (“language” & “speech” respectively) which are “approximate but inadequate”.  Langue denotes the system (or totality) of language shared by the “collective consciousness” so it encompasses all elements of a language as well as the rules & conventions for their combination (grammar, spelling, syntax etc).  Parole is the use individuals make of the resources of language, which the system produces and combines in speech, writing or other means of transmission.  As de Saussure explained it, the conjunction and interaction of the two create an “antinomy of the social and shared”, a further antinomy implied in the idea that langae is abstract and parole is concrete.

The construct of the noun antinomy was a learned borrowing from the Latin antinom(ia) + the English suffix “-y” (used to form abstract nouns denoting a condition, quality, or state).  The Latin antinomia was from the Ancient Greek ντινομία (antinomía), the construct being ντι- (anti- (the prefix meaning “against”), ultimately from the primitive Indo-European hent- (face; forehead; front)) + νόμος (nómos) (custom, usage; law, ordinance) from  νέμω (némō) (to deal out, dispense, distribute), from the primitive Indo-European nem- (to distribute; to give; to take))  + -́ (-íā) (the suffix forming feminine abstract nouns).  The English word is best understood as anti- (in the sense of “against”) + -nomy (the suffix indicating a system of laws, rules, or knowledge about a body of a particular field).  In law, it was once used to describe “a contradiction within a law, or between different laws or a contradiction between authorities” (a now archaic use) but by extension it has come to be used in philosophy, political science and linguistics to describe “any contradiction or paradox”.  A sophisticated deconstruction of the concept was provided by the German German philosopher Immanuel Kant (1724–1804) who in Kritik der reinen Vernunft (Critique of Pure Reason (1781)) explained that apparent contradictions between valid conclusions (a paradox) could be resolved once it was understood the two positions came from distinct and exclusive sets, meaning no paradox existed, the perception of one merely the inappropriate application of an idea from one set to another.

So langue is what people use when thinking and conceptualizing (abstract) while parole what they use in speaking or writing (concrete), Saussure’s evaluative distinction explained as “The proper object of linguistic study is the system which underlies any particular human signifying human practice, not the individual utterance.” and the implication of that was that langue is of more importance than parole.  In the English-speaking world, it was the work of US Professor Noam Chomsky (b 1928) which made the concept of langue & parole well-known through his use of the more accessible terms “competence” & “performance”.  Chomsky’s latter day role as a public intellectual (though a barely broadcasted one in his home country) commenting on matters such as US foreign policy or the contradictions of capitalism has meant his early career in linguistics is often neglected by those not in the profession (the highly technical nature of the stuff does mean it’s difficult for most to understand) but his early work truly was revolutionary.

Chomsky used “competence” to refer to a speaker's implicit knowledge of the rules and principles of a language, something which permits them to understand and generate grammatically correct sentences which can be understood by those with a shared competence.  Competence is the idealized, internalized system of linguistic rules that underlies a speaker's ability to produce and comprehend language. It reflects one’s mental grammar, independent of external factors like memory limitations or social context.  Performance refers to the actual use of language IRL (in real life), influenced by psychological and physical factors such as memory, attention, fatigue, and social context.  Performance includes the errors, hesitations, and corrections that occur in everyday speech and Chomsky made the important point these do not of necessity reveal lack of competence.  Indeed, understood as “disfluencies”, (the “ums & ahs” et al) these linguistic phenomenon turned out to be elements it was essential to interpolate into the “natural language” models used to train AI (artificial intelligence) (ro)bots to create genuinely plausible “human analogues”.  Chomsky argued competence should be the primary domain of inquiry for theoretical linguistics and he focused on these abstract, universal principles in his early work which provoked debates which continue to this day.  Performance, subject to errors, variability and influenced by non-linguistic factors, he declared better studied by those in fields like sociolinguistics and psycholinguistics.

Loop

Loop (pronounced loop)

(1) A portion of a cord, ribbon, etc., folded or doubled upon itself so as to leave an opening between the parts; the opening so formed.

(2) Anything shaped more or less like a closed curve, as a line drawn on paper, a part of a letter or other symbol, a part of a path, or a line of motion.

(3) A curved piece or a ring of metal, wood, or the like, used for the insertion of something, as a handle, etc.

(4) In clinical slang, an intrauterine device (IUD), so named for the “loop” shape.

(5) In aeronautics, a maneuver executed by an airplane in such a manner that the airplane describes a closed curve in a vertical plane.

(6) In urban mass-transportation, a circular area at the end of a trolley line, railroad line etc, where cars turn around; (transport); a public transport (bus, rail, tram etc) route that starts and ends at the same point.

(7) In highway design, an arm of a cloverleaf where traffic may turn off or onto a main road or highway.

(8) In road design, a ring road or beltway.

(9) In physics, the part of a vibrating string, column of air or other medium, etc, between two adjacent nodes.

(10) In electricity, a closed electric or magnetic circuit.

(11) In computing, the reiteration of a set of instructions in a routine or program (which can be intentional or an error); a sequence of instructions repeated until or while a particular condition is satisfied.

(12) In biological science, a wire, usually of platinum, one end of which is curved to form a loop, used for transferring microorganisms from one medium to another.

(13) In biochemistry, a flexible region in a protein's secondary structure.

(14) A sandbar enclosing (or nearly enclosing) a body of water.

(15) In figure skating, a school figure in which a skater traces a large half circle, a small oval within its arc, and another large half circle to complete the figure while remaining on the same skating edge.

(16) As “The Loop”, the main business centre in the CBD of Chicago, Illinois.

(17) A small or narrow opening in a wall; a loophole (archaic).

(18) In metalworking, a hot bloom of pasty consistency, to be worked under a hammer or in rolls (the old alternative spelling was loup (mass of iron)).

(19) In graph theory, an edge that begins and ends on the same vertex.

(20) In topology, a path that starts and ends at the same point.

(21) In algebra, a quasi-group with an identity element.

(22) In North American use, a sports league (now rare).

(23) In dactylography (the study of fingerprints), one of the three primary shapes assumed by the ridges (arches, loops, and whorls).  (Dermatoglyphics is the broader scientific study of the patterns of ridges on the fingers, palms, toes, and soles).

(24) To form into a loop.

(26) To enfold or encircle in or with something arranged in a loop.

(27) To fasten by forming into a loop, or by means of something formed into a loop (often followed by up).

1350–1400: From the Middle English loupe & loup (loop of cloth; loophole; noose), from the earlier lowp-knot (loop-knot), of North Germanic origin, from the Old Norse hlaup (a run), used in the sense of “a running knot”, from hlaupa (to leap), ultimately from the Proto-Germanic hlaupaną (to leap, run) (and related to the Swedish löp-knut (loop-knot), the Danish løb-knude (a running knot) and the Danish løb (a course)..Etymologists are divided over whether loop has any connection with the Middle Irish & Old Irish lúb (bend, fold, loop) and perhaps akin to “leap”; nor is it clear if there was any relationship with the Middle Dutch lūpen (lie in wait, peep, peer).  The special use in metalworking dates from 1665-1675 and was etymologically unrelated; it was from the French loupe, a special use of loupe (wen, knob, gnarl), ultimately from a Germanic source.  The verb was derived from the noun.  Loop & looping are nouns & verbs, looper is a noun, looped is a verb & adjective and loopable & loopy are adjectives; the noun plural is loops.

Inner hippie: Lindsay Lohan likes the peace sign but in an age when high definition photography makes possible, even at a distance, the precise capturing of the arches, loops, and whorls of fingerprints, it’s now a potential risk.  AI (artificial intelligence) engines are now reported as achieving a success rate in excess of 50% in generating fake fingerprints so accurately they can “fool” biometric scanners.

As an acronym, LOOP can mean (1) loss of offsite power, (2) Listed on Other Page (online marketplaces), (3) Law of One Price (finance; economic theory) and Long-Range Open Ocean Patrol (admiralty jargon).  In dactylography (the study of fingerprints), the three primary shapes assumed by the ridges (arches, loops, and whorls) were first formerly defined in 1880.  It was first used of magnetic recording tape or film in 1931 while in computer programming in the sense of “a sequence of instructions, executed repeatedly”, the first known reference dates from 1947.  The noun looper (plural loopers) can mean (1) someone who loops (in various contexts, (2) an instrument or tool, such as a bodkin, for forming a loop in yarn or cord etc, (3) A moth having a caterpillar which arches its body into a loop in order to bring the back part of the body forward as it walks due to having fewer prolegs (an appendage of the abdomen of some insect larvae), (4) a (no almost always electronic) tool for creating music loops, (5) a golf caddy and (6) in baseball, a synonym of blooper (a fly ball that is weakly hit just over the infielders).  The adjective loopy can describe (1) something in such a shape or (2) (in slang) someone thought crazy or deranged.  The latter meaning dates from as late as 1923 but a century earlier it had entered English in the sense of “crafty or deceitful) in the novels of Sir Walter Scott (1771–1832).

There are literally dozens of derived “loop” phrases and idiomatic forms, some of the better known being: “infinite loop” (also as endless loop) (in computer programming a series of instructions which repeats until interrupted), “feedback loop” (a self-reinforcing or self-weakening effect which was used in the language of the military, political science, psychology, physics and other fields before becoming popular in discussions of global warming, “close the loop” (in managerial jargon, to follow up; to tie up loose ends; to resolve), “in the loop” (being well-informed; up to date; having current knowledge; being part of the discussion; the companion antonym being “out of the loop”, “fruitloop” (someone thought crazy or deranged (Fruit Loops originally a brand of sugary breakfast cereal), “death loop” (in video gaming the situation in which a player is killed and then respawns in the exact same time and place, destined thus endlessly to be killed, usually in a gruesome way, “belt loop” (the fittings on trousers & skirts through which one’s belt passes), “Lebanese loop” (in slang the “skimming device” fitted to an automatic teller machine (ATM or “cash dispenser”) used by criminals to collect personal information (such as pin numbers), “loophole” (in figurative use an ambiguity or exception in a rule or law that can be exploited in order to avoid the usual consequences (and originally "a slit in a castle wall used for observation or mounting a weapon)) and “loop quantum gravity” (a mysterious theory which attempts to reconcile quantum mechanics and general relativity, according to which space can be regarded as an extremely fine fabric of finite loops).

Beauty Loop is a popular scheme, said now to enjoy a membership in excess of 4½ million Beauty Discoverers, Devotees, Aficionados & Connoisseurs (MECCA doesn’t publish a breakdown) but in 2023 there was on-line speculation there may be an exclusive, secret layer of the loop (presumably known as Level 5) for those who spend much more.  It all sounded quite Masonic and there was speculation at least some MECCA staff must know about the mysterious Level 5 but were not permitted to discuss it and, if asked, were instructed to deny the existence of such a thing.  What Level 5 Beauty Loop members would be called attracted speculation and the most popular suggestions were “Beauty Addict”, “Beauty Obsessive” & “Beauty Cultist”, the consensus being floor staff would be able to confirm the identity of Level 5 members by some unobvious and ambiguous flag in the MECCA database rather than something Masonic like a secret handshake.  Fueling the conspiratorial atmospherics, MECCA seems to have adopted the Pentagon's "neither confirm nor deny" policy (invoked usually when questioned about the existence of nuclear weapons in certain places) so the hunt for a MECCA "deep throat" continues.

Epizeuxis

Epizeuxis (pronounced ep-i-zook-sis)

A literary or rhetorical device used as a figure of speech in which a word or phrase is repeated emphatically with the intention of producing some desired effect.

1580–1590: From the Modern Latin epizeuxis, from the Ancient Greek ἐπίζευξις (epízeuxis) (a fastening together, a joining; in rhetoric the repetition (of words), from ἐπιζευγνύναι (epizeugnúnai), the construct being epi- (the epi- prefix was from the Ancient Greek ἐπί (epí) (on top of; in addition to (in a special use in chemistry), it denotes an epimeric (of or pertaining to an epimer (any diastereoisomer that has the opposite configuration at only one of the stereogenic centres) form)).+ zeûxis (the yoking (of oxen)); a joining) a verbal noun from ζευγνύναι (zeugnúnai) (to yoke, to join).  Epizeuxis is a noun; the noun plural is epizeuxes.

In speeches and in debate (that term often used generously when they’re involved), politicians use epizeuxis essentially because they’ve been taught to follow what works in advertising: use simple words and phrases (preferably a TWS (three word phrase)), endlessly repeated in a manner of delivery something like a school teacher uses with the less bright children.  There’s seems a tendency among the more cynical commentators to suggest the less sincere a politician is, the more they’re inclined to be epizeuxistic and while that’s impressionistic, cases like Sir Tony Blair (b 1953; UK prime-minister 1997-2007 (education, education, education)) and Dr Kevin Rudd (b 1957; Australian prime-minister 2007-2010 & 2013 (jobs, jobs, jobs)) do come to mind.  Still, in the hands of a master rhetorician, an epizeuxis, especially if unexpected, can be effective.

In the 1964 US presidential election Lyndon Johnson (LBJ, 1908–1973; US president 1963-1969) faced the Republican nominee Barry Goldwater (1909–1998), the contest dubbed by some as “a crook versus a kook”.  Only days before the poll, LBJ turned up at Cresent City’s Jung Hotel in New Orleans to deliver a campaign speech which he began conventionally enough, telling the audience of 1500 Louisiana democrat faithful he would enforce the new civil rights law, guaranteeing every American free access to all public accommodations, which had passed with Senate support from “two thirds of the Democrats and three-fourths of the Republicans.  Years later, he would note the applause “…was less than overwhelming.”  He then paused before telling them of the words spoken to him by an old, dying Texas senator who had told house speaker Sam Rayburn (1882–1961) he wished he was well enough because “I would like to go back down there and make them one more Democratic speech.  I have one in me.  Poor old state, they haven’t heard a real Democratic speech in 30 years. All they ever hear at election time is Nigra, Nigra, Nigra.

Even south of the Mason-Dixon Line, in 1964 for a president to utter the “N-word” (albeit in the form of a “polite southernism”) was startling and the reports in the press spoke of “...a collective gasp in the room” before the Southern audience gave the Southern president “…a five-minute standing ovation.  It should though be remembered that in his massive biography (The Years of Lyndon Johnson, four of five volumes (1982-2012) thus far published), Robert Caro (b 1935) did note the conversion to racial equality came late in his life, his earlier uses of “Nigra, Nigra, Nigra” having a harsher edge.  Still, LBJ did achieve much to advance civil rights in the US and had the war in Vietnam not consumed his presidency, he would now be remembered differently although it was the reaction to his domestic policies which triggered the birth and growth of the “New Right” and the neo-liberal economic order which staged history’s greatest corporate takeover (ie most of the planet).  Political scientists have written much on the roots and evolution of the “New Left” but there remains a tendency to focus on the Reagan-Thatcher era (Ronald Reagan (1911-2004; US president 1981-1989) & Margaret Thatcher (1925–2013; UK prime-minister 1979-1990) as a kind of sudden “revolution” rather than something which really began in the wake of Goldwater’s massive defeat in 1964.

In rhetoric & literary use, the devices related to epizeuxis includes “anaphora, “diacope”, “contrastive reduplication” while in song writing and poetry there’s also “incremental repetition” (where a line is repeated with slight variations to advance the narrative or argument) and “refrain” (where a phrase or line repeated regularly, usually at the end of a stanza or verse.  Epizeuxis (known also as palilogia) involves the immediate repetition of words or phrases without any intervening words and often reinforced with, if written, an exclamation mark or if spoken, some sort of gesture.  As a device to convey vehemence, it works by emphasizing some point by (1) repetition & (2) delivery in quick succession.  It’s not the most refined of devices and in literature is best used with some infrequency because the power of its novelty fades fast although if deployed for comic effect, it can be used more often.  Joseph Conrad’s (Józef Teodor Konrad Korzeniowski, 1857–1924) use of “The horror, the horror!” in Heart of Darkness (1899) is a classic example of the effect but as endlessly used in advertising, it’s often just intrusive.

Anaphora (from the Ancient Greek ἀναφορά (carrying back)) is the repetition of words or phrases at the beginning of successive sentences or clauses.  Borrowing from poetry and often the chorus passages from various forms of music, it creates emphasis and rhythm.  It was a favourite of William Shakespeare (1564–1616) and “This blessed plot, this earth, this realm, this England” from Richard II (1595) illustrates how he used anaphora to make language flow.  The companion term is epistrophe (or epiphora), the repeating of words at a clauses' end.  The combination of anaphora and epistrophe results in symploce.

A diacope (from the Ancient Greek diakopḗ (cut in two) involves the repetition of words or phrases with a few intervening words, the emphasis achieved by a “sandwiching” (a special class of interpolation in structural linguistics) the repeated elements.  Again, Shakespeare provides perhaps the most famous example in English in having the Danish prince say “To be or not to be” (Hamlet (circa 1600) and a classically simple example is Ian Fleming’s (1908–1964)”Bond, James Bond”.  In linguistics there are three classes of diacope: (1) Vocative Diacope in which the repeated words are separated by nouns which directly are addressed (ie the noun must address something, or someone), (2) Elaborative Diacope where an adjective is used between the repeated words to enhance the meaning of the repeated word and (3) The extended diacope where for even more emphasis a word is repeated more than twice.

(although author and one-time communist Jessica Mitford (1917-1996) liked "you-know-what-bian" which never caught on)  In this context “girlfriend” is exemplified by the gang of four in the HBO television series Sex and the City (1998–2004), based on Candace Bushnell’s (b 1958) compilation (the book Sex and the City (1996)) of columns (1994-1996) under the same title written for the New York Observer.  The same thing could be achieved by the adoption of the convention of using “girl friend” for friends and “girlfriend” for lovers (as men use the word) but that really works only in writing or with the addition of visual clues.

Contrastive reduplication (CR to the practitioners who treat the analysis as “phrasal focus movement (PFM)” although in the way of academic life it’s also called “identical constituent compounding” (ICC), “lexical cloning (LC)” “contrastive focus reduplication” (CFR) or “double construction” (DC), all grouped under the rubric of “syntactic reduplication” (SR)) is a widely practiced phenomenon of conversational speech in which a word or larger constituent is reduplicated to single out a default or prototypical meaning, one of the duplicates receiving or imparting the contrastive (focal) stress.  Sometimes used in conjunction with “air quotes”, structurally CR often makes no sense if deconstructed literary but they are widely understood:  “Do you like him or like-like him?” is in no way ambiguous, the first “like” interpreted as the default (dictionary” definition, the “duplicated like” carrying the “loaded” meaning.  In English, the first part of the reduplicant bears contrastive intonational stress.

Consecrate

Consecrate (pronounced kon-si-kreyt)

(1) To make or declare sacred; set apart or dedicate to the service of a deity (most often in the context of a new church building or land).

(2) To make something an object of honor or veneration; to hallow.

(3) To devote or dedicate to some purpose (usually in the form “a life consecrated to something”) usually with some hint of solemnly.

(4) In religious ritualism, to admit or ordain to a sacred office, especially (in the Roman Catholic Church) to the episcopate.

(5) In Christianity to sanctify bread and wine for the Eucharist to be received as the body and blood of Christ.

1325–1375: From the Middle English consecraten (make or declare sacred by certain ceremonies or rites), from the Latin & cōnsecrātus & cōnsecrāre (to make holy, devote), perfect passive participle of cōnsecrō, the construct being con- (from the Latin prefix con-, from cum (with); used with certain words (1) to add a notion similar to those conveyed by with, together, or joint or (2) to intensify their meaning) + sacrāre (to devote) (from sacrō (to make sacred, consecrate”), from sacer (sacred; holy).  The most frequently used synonyms are sanctify & venerate (behallow is now rare); the antonyms are desecrate & defile.  The original fourteenth century meaning was exclusively ecclesiastical, the secular adoption in the sense of "to devote or dedicate from profound feeling" is from the 1550s.  The verb was the original for, the noun consecration developing within the first decade of use; it was from the Latin consecracioun (the act of separating from a common to a sacred use, ritual dedication to God) and was used especially of the ritual consecration of the bread and wine of the Eucharist (from the Latin consecrationem (nominative consecratio)), a noun of action from past-participle stem of consecrare.  In the Old English, eallhalgung was a loan-translation of the Latin consecratio.  Consecrate is a verb & adjective, consecration, consecratee, consecratedness & consecrater (also as consecrator) are nouns, consecrates, consecrated & consecrating are verbs and consecratory & consecrative are adjectives; the most common noun plural is consecrations.

The common antonym was desecrate (divest of sacred character, treat with sacrilege), dating from the 1670s, the construct being de- + the stem of consecrate.  The de- prefix was from the Latin -, from the preposition (of, from (the Old English æf- was a similar prefix).  It imparted the sense of (1) reversal, undoing, removing, (2) intensification and (3) from, off.  In the Old French dessacrer meant “to profane” and a similar formation exists in Italian.  However, the Latin desecrare meant “to make holy” (the de- in this case having a completive sense).  In Christianity, to deconsecrate is not a desecration but an act of ecclesiastical administration in which something like a church or chapel ceases to be used for religious purposes and is able to be sold or otherwise used.  It means that in Christianity the notion of “sacred sites” is not of necessity permanent, unlike some faiths.  The alternative unconsecrated seems now obsolete but was once used as a synonym of deconsecrated (and also in clerical slang to refer to laicization (defrocking)).  The un- prefix was from the Middle English un-, from the Old English un-, from the Proto-West Germanic un-, from the Proto-Germanic un-, from the primitive Indo-European n̥-.  It was cognate with the Scots un- & on-, the North Frisian ün-, the Saterland Frisian uun-, the West Frisian ûn- &  on-, the Dutch on-, the Low German un- & on-, the German un-, the Danish u-, the Swedish o-, the Norwegian u- and the Icelandic ó-.  It was (distantly) related to the Latin in- and the Ancient Greek - (a-), source of the English a-, the Modern Greek α- (a-) and the Sanskrit - (a-).

The word "consecrate" is of interest to etymologists because of the history.  By the early fifth century, Rome was forced to recall the legions from Britain because the heart of the empire was threatened by barbarian invasion.  This presented an opportunity and not long after the soldiers withdrew, the Angles, Saxons and Jutes landed on the shores of the British Isles, beginning the Germanic invasion which would come to characterize Britain in the early Middle Ages.  As the invaders forced the native Celts to escape to Wales, Ireland and the northern districts of Scotland, the Celtic language and indeed the last residues of Latin almost vanished; in a remarkably short time, the culture and language in most of what is now England was almost exclusively Germanic.  It was the arrival of Christianity in the sixth century which caused Latin to return; with the faith came nuns & priests and the schools & monasteries they established became centres of literacy and stores of texts, almost all in Latin.  For a number of reasons, the Germanic tribes which by then had been resident for five generations, found Christianity and the nature of the Roman Church attractive and readily adopted this new culture.  At this time words like temple, altar, creed, alms, monk, martyr, disciple, novice, candle, prophet and consecrate all came into use and it was the mix of Latin & the Germanic which formed the basis of The Old English, a structure which would last until the Norman (as in "the Northmen") invasion under William the Conqueror (circa 1028-1087; King William I of England 1066-1087) in 1066 at which point Norman-French began to infuse the language.

Additionally, just as buildings, land and other objects can be consecrated and deconsecrated, they can subsequently be reconsecrated (to consecrate anew or again), a verb dating from the 1610s.  In the wars of religion in Europe and places east, when buildings often swapped in use between faiths as the tides of war shifted, this lead even to theological debate, some arguing that when a church was re-claimed, there was no need to perform a reconsecration because there had been no valid act of deconsecration while other though “a cleansing reconsecration” was advisable.  The re- prefix was from the Middle English re-, from the circa 1200 Old French re-, from the Latin re- & red- (back; anew; again; against), from the primitive Indo-European wre & wret- (again), a metathetic alteration of wert- (to turn).  It displaced the native English ed- & eft-.  A hyphen is not normally included in words formed using this prefix, except when the absence of a hyphen would (1) make the meaning unclear, (2) when the word with which the prefix is combined begins with a capital letter, (3) when the word with which the is combined with begins with another “re”, (4) when the word with which the prefix is combined with begins with “e”, (5) when the word formed is identical in form to another word in which re- does not have any of the senses listed above.  As late as the early twentieth century, the dieresis was sometimes used instead of a hyphen (eg reemerge) but this is now rare except when demanded for historic authenticity or if there’s an attempt deliberately to affect the archaic.  Re- may (and has) been applied to almost any verb and previously irregular constructions appear regularly in informal use; the exception is all forms of “be” and the modal verbs (can, should etc).  Although it seems certain the origin of the Latin re- is the primitive Indo-European wre & wret- (which has a parallel in Umbrian re-), beyond that it’s uncertain and while it seems always to have conveyed the general sense of "back" or "backwards", there were instances where the precise was unclear and the prolific productivity in Classical Latin tended make things obscure.  The Latin prefix rĕ- was from the Proto-Italic wre (again) and had a parallel in the Umbrian re- but the etymology was always murky.   In use, there was usually at least the hint of the sense "back" or "backwards" but so widely was in used in Classical Latin and beyond that the exact meaning is sometimes not clear.  Etymologists suggest the origin lies either in (1) a metathesis (the transposition of sounds or letters in a word) of the primitive Indo-European wert- (to turn) or (2) the primitive Indo-European ure- (back), which was related to the Proto-Slavic rakъ (in the sense of “looking backwards”).

Rose Aylmer is Landor’s best remembered poem, one he dedicated to Rose Whitworth Aylmer (1779-1800), daughter Lord Aylmer and his wife Catherine Whitworth.  Rose sailed to India with an aunt in 1798, dying from cholera within two years. The poem is epigrammatic, written in tetrameters and trimeter iambics with rhyming alternate lines.  It’s a lament for the loss of a divine creature for Rose was imbued with every virtue and grace, the last two lines verse alluding to memories of their night of passion he so vividly recalls, consecrating its memory to her.

Consecration and the Church

Movie makers sometimes dig into religious themes for plot-pieces or props and one which has been used by those working usually in the horror or supernatural genres is the idea “the dead can’t arise from unconsecrated soil”, one implication being the soul of the deceased cannot ascend to heaven and are compelled for eternity to lie cold and lonely (in horror films there are also other consequences).  However, there’s no basis for this in Christian theology and noting in Scripture which could be interpreted thus but the consecration of burial grounds and the burial of the deceased in consecrated earth seems to have a long tradition in Christianity.  The idea though clearly bothered some and there’s a record of a fifteenth century German bishop assuring seafarers that Seebestattung (burial at sea) is proper, the ceremony alone a sufficient act of consecration.  So, in the Christian tradition, consecrated ground for a burial seems “desirable but not essential”, one’s salvation depending on faith in Jesus Christ and God's grace, not where one’s early remains are deposited.

There were though some other restrictions and in many places the Church did not permit those who had died by their own hand to be laid to rest within the consecrated boundaries of a cemetery; those sinners were buried just outside in unconsecrated ground.  The tradition seems mostly to have been maintained by the Jews and Roman Catholics although it was not unknown among the more austere of other denominations, evidence still extant in the United States.  After the Second Vatican Council (Vatican II; 1962-1965), rules in the Catholic Church were relaxed and the burial in consecrated ground of those who had committed suicide became a matter for the parish priest, a referral to the bishop no longer demanded.  The attitude within Judaism doubtlessly varies according to the extent to which each sect conforms to orthodoxy but generally there has probably been some liberalization, even those with tattoos now able to have a plot among the un-inked, the old prohibition based on the prohibition of one of the many abominations listed by Leviticus (Vayikra) in Chapter 19 of the Old Testament (the Torah or Pentateuch): You shall not make cuts in your flesh for a person [who died].  You shall not etch a tattoo on yourselves. I am the Lord. (Leviticus 19:28).

The Vatican, the USAVC and Legal Fictions

The United States Association of Consecrated Virgins (USACV) is a voluntary association of consecrated virgins living in the world, the purpose of which is said to be “to provide support members in the faithful living out of their vocation to consecrated virginity” and “to assist one another in service to the Church as befits their state” (Canon 604, Code of Canon Law).

In 2018, a document from the Vatican discussing the role of consecrated virginity drew criticism from some in the USACV which alleged there was a passage in the text which seemed ambiguous.  The issue was whether entering the Church's "order of virgins" requires women genuinely are virgins (in the accepted sense of the word).  Issued on 4 July, by the Congregation for Institutes of Consecrated Life and Societies of Apostolic Life, Ecclesiae Sponsae Imago (ESI; The image of the Church as Bride) contained a passage the critics claimed was "intentionally convoluted and confusing" and appeared to suggest “physical virginity may no longer be considered an essential prerequisite for consecration to a life of virginity.  The dissenting statement called this implication "shocking", pointing out there “are some egregious violations of chastity that, even if not strictly violating virginity, would disqualify a woman from receiving the consecration of virgins”, adding “The entire tradition of the Church has firmly upheld that a woman must have received the gift of virginity – that is, both material and formal (physical and spiritual) – in order to receive the consecration of virgins.

The USAVC did seem to have a point, the ESI instructing that “it should be kept in mind that the call to give witness to the Church's virginal, spousal and fruitful love for Christ is not reducible to the symbol of physical integrity. Thus to have kept her body in perfect continence or to have practiced the virtue of chastity in an exemplary way, while of great importance with regard to the discernment, are not essential prerequisites in the absence of which admittance to consecration is not possible.  The discernment therefore requires good judgment and insight, and it must be carried out individually. Each aspirant and candidate is called to examine her own vocation with regard to her own personal history, in honesty and authenticity before God, and with the help of spiritual accompaniment.

In the spirit of Vatican II, US-based canon lawyers responded, one (herself a consecrated virgin of the Archdiocese of New York) issuing a statement saying, inter alia: “I don't see this as saying non-virgins can be virgins. I see this as saying in cases where there is a real question, it errs on the side of walking with women in individual cases for further discernment, as opposed to having a hard-dividing line to exclude women from this vocation.  The presumption of the document is that these are virgins who are doing this [consecration].  An important thing to do though is to read the questionable paragraph in context with the rest of the document.  The instruction talks a lot about the value of virginity, Christian virginity, the spirituality of virginity.  The nature of this kind of document as an instruction doesn't change the law that it's intended to explain.  The rite of consecration itself is the law, while the instruction is meant as "an elaboration for certain disputed points; it's just giving you further guidance in places where existing law is vague.

For those not sure if this helped, she went on, verging close to descending to specifics, saying the ESI was offering a “more generous description” of the prerequisite of virginity in “allowing for people in difficult situations to continue some serious discernment”, adding that what ESI appeared to do was cover those “difficult cases” in which a woman cannot answer whether she is a virgin according to a strict standard; those instances where women might have lost their virginity without willing it or against their will, or out of ignorance. Women might thus have “committed grave sins against chastity but not actually lost their virginity in their minds”.  Such a concept has long been a part of criminal law in common law jurisdictions and the Latin phrase actus reus non facit reum nisi mens sit rea (the act is not culpable unless the mind is guilty and usually clipped to “mens rea” (guilty mind)) and is the basic test for personal liability.

Had the Vatican been prepared to descend to specifics it might have avoided creating the confusion and the president of the USAVC, while noting the potentially ambiguous words, stated where “a woman has been violated against her will and has not knowingly and willingly given up her virginity, most would hold that she would remain eligible for consecration as a virgin. Such a case would require depth of good judgment and insight carried out in individual discernment with the bishop.  That seemed uncontroversial but the president continued: “In our society, questions of eligibility for the consecration of virgins are raised by those who have given up their virginity, perhaps only one time, and who have later begun again to live an exemplary chaste life.  What the ESI should have made explicit, she said, was that …these women do not have the gift of virginity to offer to Christ.  They may make a private vow of chastity, or enter another form of consecrated life, but the consecration of virgins is not open to them.  Clearly, in the view of the USAVC, the ESI does not change the prerequisites for consecration into the USAVC.  One who is a victim of a violation has surrendered nothing whereas one who willingly succumbed cannot retrospectively re-assume virginity, however sincere the regret or pure their life since.

So, according to the Vatican, the state of virginity can, in certain circumstances, be a “legal fiction”, another notion from the common law which allows certain things to be treated by the law as if they were fact however obvious it may be they are not.  That sounds dubious but legal fictions are an essential element in making the legal system work and are not controversial because they have always been well publicized (in a way which would now be called “transparent”) and if analysed, it’s obvious the alternatives would be worse.  Rome actually had “a bit of previous” in such matters.  For example, during the Renaissance, although the rules about the conduct and character of those eligible to become pope were well documented (and had once been enforced), there was Innocent VIII (1432–1492; pope 1484-1492) who, before drifting into an ecclesiastical career, had enjoyed a dissolute youth (something no less common then as now), fathering at least six or seven illegitimate children, one son and one daughter actually acknowledged.  Despite it all, he was created a cardinal and for reasons peculiar to the time proved acceptable as pope while all others did not, not because their pasts were more tainted still but because of curia politics; plus ça change…  After the vote, all the cardinals added their signatures to the document warranting Innocent VIII was of fine character.  Scandalous as it sounds, there were Renaissance popes who were plenty worse; the Vatican in those decades needed plenty of legal fictions.

Witches are also consecrated (by the coven).  Although now most associated with ecclesiastical ceremony & procedure, secular use in the sense of “to devote or dedicate (to something) from profound feeling" has existed since the mid-sixteenth century.  Just for the record, Lindsay Lohan has not been, and has no desire to be consecrated a witch.
